DePuy has Recalled Two Hip Replacement Devices:

DePuy Orthopaedics has recalled two of its hip replacement devices.  These recalls include the DePuy Resurfacing System and the ASR LX Acetabular System.  This subsidiary of Jonson and Johnson has reported a number of hip replacement failures and found it necessary to recall these units.  It is believed that these systems have a design flaw that prevents them from being positioned properly.

DePuy states that they will consider reimbursement for certain expenses that they deem reasonable for patients who have experienced complications from these implants.  Before signing over your rights to secure an early hip replacement settlementwith DePuy, it is important to consult with a hip replacement attorney to make sure you are properly compensated.  Additional treatment and surgeries may be necessary as a result of your DePuy ASR hip replacement failures, requiring more money to settle your claim than the manufacturer deems necessary.  Just compensation may involve payment for past and future medical treatment, lost wages and pain and suffering.

Many factors are involved in determining the amount of any hip replacement settlement. These factors include extent and duration of the injury, overall physical and mental health affected, past and future pain suffered and disfigurement caused.  Settlements should be based on individual situations and factors and there is no set amount that will properly compensate all injuries given that each patient experiences different complications as a result of this recall

Both individual personal injury lawsuits and hip replacement class actionlawsuits are being filed.  Those filed in federal courts are likely to be consolidated and coordinated during pretrial litigation.  If DePuy doesn't settle during pretrial meetings a small number of claims will be selected for early trials (bellwether cases).  These lawsuits will determine the strengths and weaknesses of these cases in general.  These trials quite often help to negotiate an agreement to settle other lawsuits.

National Coordination of DePuy Hip Implant Lawsuits:

A PRNewswire release, on October 21, 2010 reported that a panel of 7 judges granted a motion for a hearing to determine the national coordination of all DePuy hip implant cases (multidistrict litigation or MDL).  The motion was granted on October 15, 2010 and the hearing was set for November 18, 2010.

If you have received a DePuy hip implant and are interested in considering legal action, you should consult with an independent attorney and discuss specific advantages of pursuing your own action versus joining a hip replacement class action

If you have experienced DePuy hip replacement complications such as long-term pain, prosthesis fracture, inflammation, or any other DePuy hip implant related illness you may be entitled to financial compensation for pain and suffering, lost wages and medical costs.  You might want to talk with a hip replacement lawyer about a hipreplacement class actionsuit or a hip replacement settlement.  Hip replacement lawsuits are being filed around the country.
